KazMuayGaz NC JSC regulatory environment survey

KazMuayGaz NC JSC (hereinafter KMG) is formed by merger of closed joint stock companies such as National Oil and Gas Company Kazakhoil and National Company Oil and Gas Transport in accordance with the Decree of the President of the Republic of Kazakhstan dated February 20, 2002 No 811 for the purpose of implementation level increase and protection of interests of the Republic of Kazakhstan in oil and gas sector.

The main object of KMG activity is:

involvement in the united state policy implementation in oil and gas industry;
effective and efficient oil and gas resources development;
involvement in strategy development of oil and gas resources further use, recovery and increase;
representation of state interests in contracts with contractors, carrying out oil and gas operations through obligatory share interest in the contracts as required by law.

The specified order is regulated by Rules of state interests’ representation in the contracts by national company, including national company share interest, approved by the Government Decree of the Republic of Kazakhstan from February 10, 200 No 122;

involvement in tender activity for oil and gas operations on the territory of the Republic of Kazakhstan;
corporate governance and monitoring on hydrocarbons exploration, development, production, processing, sale, transportation and oil and gas pipeline and infrastructure design, construction and operation;
involvement in internal and international projects of the Republic of Kazakhstan on oil and gas operations implementation as required by law.

The central executive body of the Republic of Kazakhstan, carrying out state policy formation, management process coordination in oil and gas areas, petrochemical industry and raw hydrocarbon deposits transportation is Ministry of Oil and Gas of the Republic of Kazakhstan.

The Regulations of the Ministry of Oil and Gas of the Republic of Kazakhstan is approved by the Government Decree of the Republic of Kazakhstan from May 20, 2010 No 454.

In accordance with State program on forced industrial and innovative development of the Republic of Kazakhstan for 2010 – 2014, approved by Presidential Decree from March 19, 2010 No 958 KMG is the major operator of oil and gas industry development, which will be focused on domestic capacity development in oil and gas production area by direct involvement in major projects, development and new deposits start-up, geological exploration works financing and carrying out.

According to he Government Decree of the Republic of Kazakhstan from April 2, 2002 No 390 KMG is entrusted with working body functions of the Ministry of Oil and Gas of the Republic of Kazakhstan on construction activity regulation in oil and gas infrastructure objects planning, designing and construction, connected with main oil pipelines transportation, storing and transshipment to other transportation vehicles and in oil and gas infrastructure existing facilities use.

KMG is also given an important role in Program implementation on oil and gas sector development in the Republic of Kazakhstan for 2010-2014, approved by the Government Decree of the Republic of Kazakhstan from October 18, 2010 No 1072, the objectives of which are the following:

established indicators achievement on oil and gas-condensate extraction and export;
provision of domestic requirements in oil and gas products;
provision of hydrocarbon developed reserves increase and production level taking out to the high level;
domestic raw hydrocarbon deposits (oil and gas) depth and output increasing;
export routes diversification for oil and gas transportation;
petrochemical production with high added value export increase;
harmonization of industry technical regulation standards;
Kazakhstan oil and gas companies level increase
Specialists training of all levels for new production in oil and gas industry;
Labor security and negative environmental impact decrease.

The main legislative acts regulating KMG activity are:

Law of the Republic of Kazakhstan "On Subsurface Resources Use";
Law of the Republic of Kazakhstan "On Joint Stock Companies";
Law of the Republic of Kazakhstan "On the National Welfare Fund";
Law of the Republic of Kazakhstan "On State Property ';
Law of the Republic of Kazakhstan "On state regulation of certain types of oil products production and turnover", etc.

Purchases are made in accordance with products purchase rules, works and services made by National Welfare Fund Samruk Kazyna JSC and organizations, which fifty or more percent of shares are directly or indirectly owned by Samruk Kazyna JSC in freehold or trust management basis, approved by the Board of the Directors of Samruk Kazyna JSC dated November 18, 2009 No 32.

Now with KMG active participation the draft laws of the Republic of Kazakhstan “On Gas and gas supply”, “On main pipeline” are worked out.
